Copyright Infringement Notice

Luxury Communities respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond promptly to claims of copyright infringement committed using our platform.

Filing a DMCA Notice

If you believe that content on our Site infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location on the Site
  4. Your contact information, including address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. The counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the Western District of North Carolina

Repeat Infringers

In accordance with the DMCA, Luxury Communities will terminate the accounts of users who are determined to be repeat infringers. We may also limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others.

MLS Content

Property listing data, including photographs, is sourced from multiple listing services (MLS) and is displayed under license. If you believe MLS-sourced content infringes your copyright, please include this information in your DMCA notice so we can coordinate with the appropriate MLS.

Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.
